This Agreement is entered into by and between Sharon McCall of Whispering Fields Wellness (the Coach) and the purchaser of any one-on-one stress recovery coaching program (the Client). The Coach and the Client agree to enter into the coaching services and professional relationship specified in this document.
COACH – CLIENT RELATIONSHIP
- Coaching is for people who are basically well adjusted, emotionally healthy, functioning fairly effectively, and wanting to make improvements in their lives.
- Coaching is a relationship between a client and a coach that is designed to facilitate the creation and development of the Client’s personal goals. The relationship is also designed to develop strategies to carry out a plan for achieving those goals. Coaching is typically about current life choices and planning for the future, not about repairing or uncovering the past.
- Coaching can involve brainstorming, values clarification, the completion of written assignments, education, goal-setting, identifying plans of action, accountability, making requests, agreements to change behavior, examining lifestyles, and questioning.
- Coaching is most effective when there is honest and straightforward communication.
- The Coach acknowledges that the Client is the expert in navigating their own life, based on personal preferences and experiences.
- The Client is solely responsible for decisions, actions, choices, lifestyle changes, and results.
- The Client acknowledges that the Coach acts as a facilitative partner and that the Coach’s primary role is to diagnose, advise, or instruct the Client on what to do.
- The Client recognizes that coaching is not psychotherapy nor medical care. Professional referrals will be given if needed. Coaching is not to be used instead of professional advice for: prescribing or assessing specific meal plans; provide healthcare, medical, psychological, or nutrition therapy services; diagnose, test or cure any disease, condition, or other physical or mental ailment of the human body; or pastoral care for spiritual issues.
- The Client acknowledges that, if under care of licensed health professionals, the Client should discuss any food, supplement, or lifestyle changes with them. If the Client currently uses prescription medications, the Client should not discontinue any prescription medicines without first consulting the healthcare provider.
- The Client agrees to communicate honestly and dedicate their time and energy to participating fully in the Program.
- The Client understands that Sharon McCall is a Christian Health Coach and holds a Biblical world-view. The Coach respects the beliefs and values of others. She does not seek to impose her values on another, proselytize, or condemn people who do not share similar values and beliefs.
SERVICES
The parties agree to engage in the Program, which includes the following:
There are 6 weekly sessions and scheduled across 2 months (or 8 weeks). Each will be at least one hour and will be an online meeting. The dates, times, and links will be provided prior to the kick-off session. The appointment times will be fixed each week based on a mutually agreed-upon time.
Either the Coach or Client may choose to record the sessions.
Client will be signed up for the newsletter, which is sent approximately 2 times per month.
PROGRAM FEES
The program fee is $960.
The payment link used determines the fee amount and the payment terms. There is no further discounting or rebates.
- During the consultation call, the client can request a payment plan link. The first half is paid upfront and the balance is paid prior to the 4th session. The 4th, 5th, and 6th sessions will not occur until full payment is made.
- Otherwise, the fee is to be paid upfront at the time of the online booking.
SCHEDULING / CANCELLATION / GUARANTEES
- If the Client needs to cancel or reschedule the appointment, the Client must do so 24 hours in advance via email to: Sharon@WhisperingFieldsWellness.com; otherwise the Client will forfeit the appointment and will not have an opportunity to reschedule it.
- If the Coach cancels a session or is late, communication will be sent via email or text message to the Client as soon as possible. Make-up instructions will be provided in the communication.
- This Program expires if the 6 sessions have not been completed within 8 weeks of the kick-off session.
- The Client may request a refund in writing up to 24 hours prior to the 2nd session. The request is to be sent via email to: Sharon@WhisperingFieldsWellness.com. The refund will be sent within 30 days of request.
- At any time, the Client must submit via email to: Sharon@WhisperingFieldsWellness.com intent to withdrawal from the Program.
- The Coach reserves the right to cancel the Program if at any point the Coach feels it’s not advantageous for the Program to continue, this includes reserving the right to make a values-based referral. Coaching requires trust, honesty, and mutual respect, there could be a situation as the client-coach relationship develops where differences in values and beliefs are beyond the Coach’s capability to provide effective support. The Client will receive a pro-rated refund based on number of sessions used. The refund will be sent within 30 days of Client being informed.
- Except as expressly provided in this agreement, there are no guarantees or warranties, express or implied as to the outcomes of the Program.
PERSONAL RESPONSIBILITY & RELEASE OF HEALTHCARE-RELATED CLAIMS
The Client acknowledges that the Client takes full responsibility for the Client’s life and well-being, as well as the lives and well-being of the Client’s family and children (where applicable), and all decisions made during and after the Program.
The Client expressly assumes the risks of the Program, including the risks inherent in making dietary and/or lifestyle changes. The Client releases the Coach from any and all liability, damages, causes of action, allegations, suits, sums of money, claims, and demands whatsoever, in law or equity, which the Client ever had, now has, or will have in the future against the Coach, arising from the Client’s past or future participation in, or otherwise with respect to, the Program, unless arising from the gross negligence of the Coach.
CONFIDENTIALITY & INTELLECTUAL PROPERTY
- Coach-Client relationship is not considered a legally confidential relationship (like the medical, counseling and legal professions). The Coach follows the principles of confidentiality set forth in the Code of Ethics of the International Christian Coaching Association (available at: https://christiancoachingtoday.com/wp-content/uploads/2022/11/ICCA-Code-of-Ethics-1.pdf).
- The Coach will keep the Client’s information private and will not share the Client’s information with any third party without the Client’s written consent unless:
- Client becomes danger to self or someone else, abuses another person or discloses a crime,
- Client is involved in a court case against the Coach, or other situations as required by law.
- The Coach will not disclose the Client’s name as a reference or for use in any marketing materials without the Client’s written consent.
- Neither the Coach nor the Client will use session recordings outside the scope of the Program, unless required by law or written consent by both parties.
- The Coach is willing to collaborate with professionals through a signed Release of Information, should the Client choose to, believing that will result in better outcomes.
- The Client will respect usage of the Coach’s intellectual property and will not use them outside the Program and their personal self-care.
ARBITRATION, CHOICE OF LAW AND LIMITED REMEDIES
- If the Client is dissatisfied with the services or results, the Client will first seek to directly remedy the situation with the Coach verbally and in writing. This is to be honestly addressed by both parties within the confidentiality of the Coach-Client relationship.
- Any claim or dispute arising from or related to this agreement shall be settled by mediation and, if necessary, legally binding arbitration, in accordance with the rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation (available at: https://www.instituteforchristianconciliation.com/rules/); judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction.
- During the course of either of the above situations, both parties agree not to publicly disparage or slander each other. Subsequently, they will adhere to the judgment.
- This Agreement shall be construed according to the laws of the State of Texas and State of [your state]. If any provision of this Agreement is deemed unenforceable, the remaining portions of the Agreement shall not be severed and remain in full force.
If the terms of this Agreement are acceptable and the Client understands, accepts, and agrees to abide by the terms, the Client will purchase the course and mark the appropriate check box. A copy of this Agreement will be provided to the Client with the Welcome Email.
